These terms of service ("Terms") govern your access to and use of the website at 7emple.nl ("Website"), operated by 7EMPLE ("we", "us", "our"), a creative marketing agency established under Dutch law.

By accessing or using this Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Website immediately.

These Terms constitute general terms and conditions (algemene voorwaarden) within the meaning of Article 6:231 of the Dutch Civil Code (Burgerlijk Wetboek, "BW").

2. Scope

These Terms apply to all use of the Website, including but not limited to:

• Browsing pages and viewing content
• Submitting a contact form or enquiry
• Applying for the Ascend programme
• Downloading any materials made available on the Website

These Terms do not govern the provision of services by 7EMPLE to its clients. The delivery of creative, branding, videography, content, or related services is subject to a separate service agreement between 7EMPLE and the client.

3. Use of the Website

3.1 Permitted use

You may use the Website for lawful purposes only and in accordance with these Terms. You agree not to use the Website:

• In any way that violates any applicable Dutch, EU, or international law or regulation
• To transmit or facilitate the transmission of any unsolicited commercial communications (spam)
• To attempt to gain unauthorised access to the Website, its servers, or any connected systems
• To interfere with or disrupt the integrity or performance of the Website
• To engage in any automated data collection, scraping, or crawling without our prior written permission

We make reasonable efforts to keep the Website accessible, but we do not guarantee uninterrupted availability. We may suspend, modify, or discontinue the Website (or any part of it) at any time without prior notice and without liability.

4.1 Ownership

• Reproduce, distribute, modify, or create derivative works from any content on this Website
• Use any content from this Website for commercial purposes
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Frame, mirror, or otherwise incorporate any part of this Website into another website or service

4.3 Portfolio and client work

Case studies, project visuals, and client work featured on this Website are displayed with the relevant client's permission. The intellectual property rights in such work are governed by the applicable service agreement between 7EMPLE and the client.

4.4 Limited licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Website for personal, non-commercial use. This licence does not include the right to download (other than standard page caching), reproduce, or re-use any content.

5. Contact Form and Submissions

5.1 Data submitted

When you submit a contact form, application, or any other message through the Website, you agree that:

• The information you provide is accurate and complete
• You are authorised to provide the information submitted
• Your submission does not contain any content that is unlawful, defamatory, or infringes on the rights of any third party

5.2 No obligation

Submitting a contact form or application does not create a contractual relationship between you and 7EMPLE. We are under no obligation to respond to, accept, or act upon any submission.

• Any third-party conduct or content on the Website

8.2 Mandatory liability

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded or limited under Dutch law, including mandatory provisions of Book 6 BW

8.3 Force majeure

7EMPLE is not liable for failure to perform its obligations where such failure results from circumstances beyond its reasonable control (overmacht), as defined in Article 6:75 BW, including but not limited to: natural disasters, war, pandemic, government actions, power outages, internet disruptions, and cyberattacks.

9. Indemnification

You agree to indemnify and hold harmless 7EMPLE, its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Website in violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Any content you submit through the Website

10. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be interpreted as narrowly as necessary to make it valid and enforceable, or if that is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect. This is consistent with Article 6:230 BW and the principles of reasonableness and fairness (redelijkheid en billijkheid) under Article 6:248 BW.

Your continued use of the Website after any changes constitutes your acceptance of the modified Terms. If you do not agree with the revised Terms, you must stop using the Website.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

13. Dispute Resolution

13.1 Jurisdiction

Any disputes arising out of or in connection with these Terms or your use of the Website shall be submitted to the exclusive jurisdiction of the competent court in the Netherlands (arrondissementsrechtbank), unless mandatory law prescribes otherwise.

13.2 Consumer rights

If you are a consumer within the meaning of Article 6:236 BW, mandatory consumer protection provisions of Dutch and EU law apply. Nothing in these Terms affects your statutory rights as a consumer, including rights under the Unfair Commercial Practices Directive (2005/29/EC) as implemented in Articles 6:193a–6:193j BW.

13.3 EU Online Dispute Resolution

In accordance with Regulation (EU) No 524/2013, we inform you that the European Commission provides an Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr. We are not obliged and currently not willing to participate in dispute resolution proceedings before a consumer arbitration board.
